AGENDA DESCRIPTION: The Agenda descriptions are intended to give notice, to members of the public, of a general summary of items of business to be transacted or discussed. The listed Recommended Action represents staff or a particular Committee’s recommendation. The City Council may take any action, which it deems to be appropriate on the agenda item and is not limited in any way by the recommended action. Any person wishing to address the City Council on any matter, whether or not it appears on this agenda, is requested to complete a “Request to Speak” form available at the door. The completed form is to be submitted to the City Clerk prior to an individual being heard by the City Council. Whenever possible, lengthy testimony should be presented to the City Council in writing (8 copies) and only pertinent points presented orally. Requests to speak to items on the agenda shall be heard at the appropriate point on the agenda; requests to speak about subjects not on the agenda will be heard during the Public Comment section of the meeting.

All matters listed under the Consent Calendar are considered routine and will be enacted by one vote. There will be no separate discussion of these items unless Members of the City Council, the public, or staff request specific items be removed from the Consent Calendar for separate action.

7.1 City Council Minutes from the adjourned and adjourned regular meetings of January 17, 2001. RECOMMENDED ACTION: Approve minutes as submitted.
7.2 Approve the reading by title of all ordinances and resolutions. Said ordinances and resolutions that appear on the public agenda shall be determined to have been read by title only and further reading waived. RECOMMENDED ACTION: Waive reading of ordinances and resolutions.
7.3 Treasurer’s Report RECOMMENDED ACTION: Receive and File the February 2001 Treasurer’s Report.
7.4 Warrant Register RECOMMENDED ACTION: Approve the February 21, 2001 Warrant Register in the amount of $187,445.68.
7.5 Telecommunications and Cable Television Franchises RECOMMENDED ACTION: Approve second reading and adoption of two Ordinances related to telecommunications franchises entitled: “AN ORDINANCE OF THE CITY OF LAGUNA WOODS, CALIFORNIA AMENDING IN ITS ENTIRETY TITLE 5, DIVISION 4 OF THE ORANGE COUNTY CODE WHICH WAS ADOPTED BY THE CITY OF LAGUNA RELATING TO CABLE TELEVISION SYSTEMS” AND “AN ORDINANCE OF THE CITY OF LAGUNA WOODS, CALIFORNIA, ESTABLISHING PROCEDURES FOR THE GRANTING OF FRANCHISES FOR THE PRIVILEGE OF USING AND OCCUPYING THE PUBLIC RIGHTS-OF-WAY TO INSTALL AND MAINTAIN TELECOMMUNICATIONS EQUIPMENT”
7.6 Laguna Woods Dog Park RECOMMENDED ACTION: Award a construction contract in the amount of $ 38,640.50 to JDC, Inc. for the construction of the Ridge Route Drive Dog Park, provide a contingency in the amount of $ 5,000 for unforeseen items or field changes to be approved by the City Manager, and authorize the Mayor to execute the contract on behalf of the City of Laguna Woods, subject to review as to form by the City Attorney.
7.7 Disadvantaged Business Enterprise (DBE) Program RECOMMENDED ACTION: Approve a Resolution entitled: “A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAGUNA WOODS, CALIFORNIA, APPROVING THE FINAL DISADVANTAGED BUSINESS ENTERPRISE (DBE) PROGRAM AND ESTIMATED ANNUAL GOAL OF 10% FOR FEDERAL FISCAL YEAR 2001, FOR ADOPTION AND SUBMISSION TO THE CALIFORNIA DEPARTMENT OF TRANSPORTATION (CALTRANS)”
7.8 Federal Grant Signature Authority RECOMMENDED ACTION: Approve two Resolutions authorizing the City Manager to apply for and execute documents related to state and federal grant assistance, entitled: “A RESOLUTION OF THE CITY OF LAGUNA WOODS, CALIFORNIA, AUTHORIZING THE CITY MANAGER TO APPLY FOR FEDERAL AND STATE FINANCIAL ASSISTANCE ON BEHALF OF THE CITY” AND “A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAGUNA WOODS, CALIFORNIA, AUTHORIZING THE CITY MANAGER TO EXECUTE AGREEMENTS, CERTIFICATIONS, AND AUTHORIZATIONS FOR FEDERAL FUNDED PROJECTS”

VIII. PUBLIC HEARINGS Public Hearings are scheduled for a time certain of 2:00 p.m. or as soon thereafter as possible. City Council, when considering the matter scheduled for hearing, will take the following actions:
1. Open the Public Hearing;
2. Receive staff report;
3. Hear applicant presentation;
4. Accept public testimony;
5. Allow applicant comment;
6. Close Public Hearing;
7. Council comment and questions;
8. Take appropriate actions. Those wishing to address the City Council during the Public Hearing must complete a Request to Speak Form and provide it to the City Clerk prior to the Public Hearing.
8.1 Development/Planning Fees RECOMMENDED ACTION:
A. Open the Public Hearing, and
B. Continue the Public Hearing to March 21, 2001.
8.2 Wireless Communication Facilities RECOMMENDED ACTION: A. Open the Public Hearing. B. Approve a Resolution, adopting the Negative Declaration for a Wireless Communication Facilities Ordinance, entitled: “A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAGUNA WOODS, CALIFORNIA, ADOPTING THE NEGATIVE DECLARATION FOR THE CITY OF LAGUNA WOODS WIRELESS COMMUNICATION FACILITIES ORDINANCE;” and
AND C. Introduce and approve first reading of an Ordinance regulating the process and development standards for the construction of wireless communication facilities proposed within the City, entitled: “AN ORDINANCE OF THE CITY OF LAGUNA WOODS, CALIFORNIA, ADOPTING REGULATIONS FOR WIRELESS COMMUNICATION FACILITIES PROPOSED WITHIN THE CITY OF LAGUNA WOODS.”

IX. COUNCIL BUSINESS
9.1 Consolidation of General Municipal Elections with November Statewide Elections RECOMMENDED ACTION: Discuss and direct staff to prepare and return with appropriate actions.
9.2 Orange County Fire Authority (OCFA) Governance (Mayor Ross) RECOMMENDED ACTION: Approve a Resolution in opposition to proposals to remove elected officials from the Orange County Fire Authority, entitled: “A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAGUNA WOODS, CALIFORNIA, ENDORSING THE RIGHT OF MUNICIPALITIES TO PARTICIPATE ON GOVERNING BOARD OF THE AGENCY PROVIDING ITS FIRE AND EMERGENCY SERVICES”
9.3 Appointment to Planning Advisory Committee (Councilwoman McLaughlin) RECOMMENDED ACTION: Approve the appointment of a new member to the Planning Advisory Committee.
9.4 Orange County Human Relations Council Partnership RECOMMENDED ACTION: Approve City of Laguna Woods participation in the partnership of cities, county, courts, schools and private sector that support the Orange County Human Relations Council, and authorize the transfer of $1,890 from the council Contingency account to pay Fiscal Year 2000-2001 dues.

X. CITY MANAGER’S REPORT
10.1 Fiscal Year 2000-01 Mid-Year Budget RECOMMENDED ACTION: Approve two Resolutions modifying the Fiscal Year 2000-2001 annual budget, entitled: “A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAGUNA WOODS, CALIFORNIA, AMENDING RESOLUTION 00-24 AND THE FISCAL YEAR 2000-2001 BUDGET” AND “A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAGUNA WOODS, CALIFORNIA, AMENDING RESOLUTION NO. 00-31, ESTABLISHING A COMPENSATION SCHEDULE FOR CITY EMPLOYEES, TO ADD SPECIFIC BENEFITS TO THE CITY’S CAFETERIA BENEFIT PLAN”
10.2 El Toro Road Traffic Signal Plan RECOMMENDED ACTION: Approve the addition of a new traffic signal at the Saint Nicholas Catholic Church and Lutheran Church of the Cross driveways, as conditioned by Council Resolution No. 00-07, to the El Toro Road Traffic Signal Plan.
10.3 Arts and Culture Programs RECOMMENDED ACTION: Allocate up to $9,750 in Arts and Culture funds to support: A. Free entry into the Orange County Museum of Art and Laguna Art Museum for up to 1,000 residents each (500 passes per museum, admitting 2 persons each), at a cost of up to $4,000.
B. Buying down the cost by $15.00 each of Laguna Playhouse admission tickets for 125 residents for each of the two remaining performances this season, at a cost of up to $3,750.
C. Bus rental for three arts and culture tours, focusing on architecture and ethnicity, in March, May and June, at a cost of up to $2,000.

XIV. CITY COUNCIL COMMENTS AND ANNOUNCEMENTS XV. CLOSED SESSION The City Council will meet in closed session:
A. Pursuant to the provisions of Government Code Section 54956.8, to confer with its property negotiator with regard to the terms of a possible lease or purchase of property located in the vicinity of El Toro Road and Moulton Parkway; and
B. Pursuant to the provisions of Government Code Section 54956.9 (c), to confer with legal counsel to consider possible initiation of one matter of litigation.
