AGENDA DESCRIPTION: The Agenda descriptions are intended to give notice, to members of the public, of a general summary of items of business to be transacted or discussed. The listed Recommended Action represents staff or a particular Committee’s recommendation. The City Council may take any action, which it deems to be appropriate on the agenda item and is not limited in any way by the recommended action. Any person wishing to address the City Council on any matter, whether or not it appears on this agenda, is requested to complete a “Request to Speak” form available at the door. The completed form is to be submitted to the City Clerk prior to an individual being heard by the City Council. Whenever possible, lengthy testimony should be presented to the City Council in writing (8 copies) and only pertinent points presented orally. Requests to speak to items on the agenda shall be heard at the appropriate point on the agenda; requests to speak about subjects not on the agenda will be heard during the Public Comment section of the meeting.

  1. CITY PROCLAMATIONS

All proclamations listed under this section will be enacted by one vote, unless Members of the City Council request specific items be removed for separate action. Proclamations will then be read and presented.

5.1 Certificate of Commendation – Gilbert Yorba celebrated his 100th Birthday on February 2, 2002 (02-02-02).

5.2 Proclamation – Colon Cancer Awareness Month – March 2002

5.3 Proclamation – Patriotism Week – February 16-23, 2002

  1. CONSENT CALENDAR

All matters listed under the Consent Calendar are considered routine and will be enacted by one vote. There will be no separate discussion of these items unless Members of the City Council, the public, or staff request specific items be removed from the Consent Calendar for separate action.

6.1 City Council Minutes from the adjourned regular meetings of January 16, 2002.

RECOMMENDED ACTION: Approve minutes as submitted.

6.2 Approve the reading by title of all ordinances and resolutions. Said ordinances and resolutions that appear on the public agenda shall be determined to have been read by title only and further reading waived.

RECOMMENDED ACTION: Waive reading of ordinances and resolutions.

6.3 Treasurer’s Report

RECOMMENDED ACTION: Receive and File the Quarterly Treasurer’s Report October – December 2001 and January 2002 monthly Treasurer’s Report.

6.4 Warrant Register

RECOMMENDED ACTION: Approve the February 20, 2002 Warrant Register in the amount of $456,514.04.

6.5 City Manager’s Contract Extension

RECOMMENDED ACTION: Approve a restated contract of employment for the City Manager that extends the contract period through December 31, 2007.

6.6 Fiscal Year 2001-2002 Mid-Year Budget.

RECOMMENDED ACTION: Approve a resolution AMENDING the Fiscal Year 2001-02 City budget, entitled:

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAGUNA WOODS, CALIFORNIA, AMENDING RESOLUTION 01-18 AND THE FISCAL YEAR 2001-2002 BUDGET

6.7 Home Occupation Ordinance

RECOMMENDED ACTION: Second reading and adoption of an ordinance establishing regulations for in-home businesses, entitled:

AN ORDINANCE OF THE CITY OF LAGUNA WOODS, CALIFORNIA, REGULATING HOME OCCUPATIONS WITHIN THE CITY OF LAGUNA WOODS

6.8 Guard Rail Ordinance

RECOMMENDED ACTION: Second reading and adoption of an ordinance establishing guardrail requirements for certain types of windows, entitled:

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAGUNA WOODS, CALIFORNIA, AMENDING ORDINANCE NO. 99-09 WHICH ADDS TITLE 8, “BUILDINGS AND CONSTRUCTION”, AND CHAPTER 8.02 “BUILDING CODE” TO ADD PROVISIONS FOR GUARDRAILS AT LOW WINDOW SILL CONDITIONS FOR NEW CONSTRUCTION

VII. PUBLIC HEARINGS

Public Hearings are scheduled for a time certain of 2:00 p.m. or as soon thereafter as possible. City Council, when considering the matter scheduled for hearing, will take the following actions: A. Receive staff report; B. Open the Public Hearing; C. Receive Public Comment; D. Close Public Hearing. Council comment and questions; 8. Take appropriate actions. Those wishing to address the City Council during the Public Hearing must complete a Request to Speak Form and provide it to the City Clerk prior to the Public Hearing.

VIII. COUNCIL BUSINESS

8.1 Community Services Committee Appointment

Ratify Councilmember Ring’s nomination to the City’s Community Services Committee.

8.2 Proposition 40: California Clean Water, Clean Air, Safe Neighborhood Parks and Coastal Protection Act of 2002 (Councilman Hack)

RECOMMENDED ACTION: Adopt a resolution entitled:

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAGUNA WOODS, CALIFORNIA, SUPPORTING THE CALIFORNIA CLEAN WATER, CLEAN AIR, SAFE NEIGHBORHOOD PARKS, AND COSTAL PROTECTION BOND ACT OF 2002.

8.3 Proposition 42: Transportation Congestion Improvement Act (Mayor Bouer)

RECOMMENDED ACTION: Adopt a resolution entitled:

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAGUNA WOODS, CALIFORNIA, SUPPORTING THE TRAFFIC CONGESTION IMPROVEMENT ACT

  1. CITY MANAGER’S REPORT

9.1 Cost Recovery Fee for the Removal of Illegal Signs

RECOMMENDED ACTION: Approve a resolution entitled:

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAGUNA WOODS, CALIFORNIA, ADOPTING A 56.00 DOLLAR PER SIGN FEE FOR THE REMOVAL OF ILLEGAL SIGNS.

9.2 Community Service Grants Awards

RECOMMENDED ACTION:

  1. A) Award $150,000 in Community Service grants to eight applicants (Community Services Committee); and
  2. Authorize the City Manager to execute an agreement with each grantee, subject to review by the City Attorney as to form.
