AGENDA DESCRIPTION: The Agenda descriptions are intended to give notice, to members of the public, of a general summary of items of business to be transacted or discussed. The listed Recommended Action represents staff or a particular Committee’s recommendation. The City Council may take any action, which it deems to be appropriate on the agenda item and is not limited in any way by the recommended action. Any person wishing to address the City Council on any matter, whether or not it appears on this agenda, is requested to complete a “Request to Speak” form available at the door. The completed form is to be submitted to the City Clerk prior to an individual being heard by the City Council. Whenever possible, lengthy testimony should be presented to the City Council in writing (8 copies) and only pertinent points presented orally. Requests to speak to items on the agenda shall be heard at the appropriate point on the agenda; requests to speak about subjects not on the agenda will be heard during the Public Comment section of the meeting.

  1. CONSENT CALENDAR

 

All matters listed under the Consent Calendar are considered routine and will be enacted by one vote. There will be no separate discussion of these items unless Members of the City Council, the public, or staff request specific items be removed from the Consent Calendar for separate action.

 

6.1   City Council Minutes from the regular meeting of March 19, 2003.

 

RECOMMENDED ACTION: Approve minutes as submitted.

 

6.2   Approve the reading by title of all ordinances and resolutions. Said ordinances and resolutions that appear on the public agenda shall be determined to have been read by title only and further reading waived.

 

RECOMMENDED ACTION: Waive reading of ordinances and resolutions.

 

6.3   Treasurer’s Reports

 

RECOMMENDED ACTION: Receive and File March 2003 monthly Treasurer’s Report.

 

6.4   Warrant Register

 

RECOMMENDED ACTION: Approve the April 16, 2003 Warrant Register in the amount of $293,374.51.

 

6.5   Zoning and Development Code

 

RECOMMENDED ACTION: Adopt an Ordinance entitled

 

AN ORDINANCE OF THE CITY OF LAGUNA WOODS, CALIFORNIA, ADOPTING A NEW ZONING CODE AND OFFICIAL ZONING MAP AND ADOPTING FINDINGS RELATING TO LICENSING AND OPERATIONAL STANDARDS FOR ADULT BUSINESSES AND ADULT PERFORMERS

 

6.6 Transportation Enhancement Activities Grant Program

 

RECOMMENDED ACTION: Adopt four resolutions authorizing funding applications for transportation improvement projects, entitled:

 

  1. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAGUNA WOODS, CALIFORNIA, AUTHORIZING AN APPLICATION FOR FUNDS FOR THE TRANSPORTATION ENHANCEMENT ACTIVITY (TEA) PROGRAM UNDER THE 1998 TRANSPORTATION EQUITY ACT FOR THE 21ST CENTURY FOR THE EL TORO ROAD MULTI-MODAL TRAIL/SIDEWALK PROJECT.

 

  1. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAGUNA WOODS, CALIFORNIA, AUTHORIZING AN APPLICATION FOR FUNDS FOR THE TRANSPORTATION ENHANCEMENT ACTIVITY (TEA) PROGRAM UNDER THE 1998 TRANSPORTATION EQUITY ACT FOR THE 21ST CENTURY FOR THE EL TORO ROAD MULTI-MODAL TRAIL/SIDEWALK LANDSCAPING ENHANCEMENT PROJECT.

  1. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAGUNA WOODS, CALIFORNIA, AUTHORIZING AN APPLICATION FOR FUNDS FOR THE TRANSPORTATION ENHANCEMENT ACTIVITY (TEA) PROGRAM UNDER THE 1998 TRANSPORTATION EQUITY ACT FOR THE 21ST CENTURY FOR THE MOULTON PARKWAY LANDSCAPING ENHANCEMENT PROJECT.

 

6.7 Via Campo Verde Traffic Signal

 

RECOMMENDED ACTION:

 

  1. City Council to accept project completion of a contract with Steiny and Company, Inc. for traffic signal installation at Via Campo Verde and Moulton Parkway.

 

AND

 

  1. Release contract retention in the amount of $15,270.72 (10%) withheld per government code within 35 days following recordation of Notice of Completion with the County of Orange.

 

AND

 

  1. Exonerate project posted bonds within 35 days following recordation of Notice of Completion with the County of Orange.

 

VII.  PUBLIC HEARINGS

 

Public Hearings are scheduled for a time certain of 2:00 p.m. or as soon thereafter as possible. City Council, when considering the matter scheduled for hearing, will take the following actions: A. Receive staff report; B. Open the Public Hearing; C. Receive Public Comment; D. Close Public Hearing. Council comment and questions; 8. Take appropriate actions. Those wishing to address the City Council during the Public Hearing must complete a Request to Speak Form and provide it to the City Clerk prior to the Public Hearing.

 

7.1 Morgan Stanley Sign Program (CUP-86)

 

RECOMMENDED ACTION:

 

  1. Receive Staff Report.

 

  1. Open Public Hearing

 

  1. Receive Public Comment.

 

  1. Close Public Hearing.

 

  1. Approve a resolution entitled:

 

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAGUNA WOODS, CALIFORNIA. APPROVING CONDITIONAL USE PERMIT CUP-86 ADOPTING A SIGN PROGRAM FOR THE MORGAN STANLEY BUILDING, LOCATED AT 24260 EL TORO ROAD.

 

VIII. COUNCIL BUSINESS

 

8.1 Advisory Committee Appointments

 

RECOMMENDED ACTION: Approve proposed nominations to City advisory committees.

 

  1. CITY MANAGER’S REPORT

 

9.1   Non-emergency Medical Transportation Grant Proposal

 

RECOMMENDED ACTION:

 

  1. Authorize staff to submit an application to the Orange County Office on Aging for $112,500 in FY 03/04 and $99,000 in FY 04/05 in County Tobacco Settlement Revenue to provide coordinated, subsidized senior non-emergency medical trips through an expanded City Taxi Voucher Program;

 

  1. Approve the allocation of $24,000 from the Council Contingency reserve to provide the required matching funds.

 

9.2   Southern California Edison (SCE) Open Space License and Easement (Woods End)

 

RECOMMENDED ACTION:

 

  1. Authorize the City Manger to execute a license agreement with Southern California Edison (SCE) and the County of Orange for public access across SCE property adjacent to Laguna Coast Wilderness Park, subject to approval as to form by the City Attorney.

 

AND

 

  1. Authorize the City Manager to execute an easement agreement with SCE for roadway access across City property (Woods End), subject to approval as to form by the City Attorney.

 

9.3   State Legislation Update

 

RECOMMENDED ACTION: Discuss and provide direction to staff.
