AGENDA DESCRIPTION: The Agenda descriptions are intended to give notice, to members of the public, of a general summary of items of business to be transacted or discussed. The listed Recommended Action represents staff or a particular Committee’s recommendation. The City Council may take any action, which it deems to be appropriate on the agenda item and is not limited in any way by the recommended action. Any person wishing to address the City Council on any matter, whether or not it appears on this agenda, is requested to complete a “Request to Speak” form available at the door. The completed form is to be submitted to the City Clerk prior to an individual being heard by the City Council. Whenever possible, lengthy testimony should be presented to the City Council in writing (8 copies) and only pertinent points presented orally. Requests to speak to items on the agenda shall be heard at the appropriate point on the agenda; requests to speak about subjects not on the agenda will be heard during the Public Comment section of the meeting.

  1. CONSENT CALENDAR

 

All matters listed under the Consent Calendar are considered routine and will be enacted by one vote. There will be no separate discussion of these items unless Members of the City Council, the public, or staff request specific items be removed from the Consent Calendar for separate action.

 

6.1   City Council minutes from the regular meeting of August 17, 2005.

 

RECOMMENDED ACTION: Approve minutes as submitted.

 

6.2   Approve the reading by title of all ordinances and resolutions. Said ordinances and resolutions that appear on the public agenda shall be determined to have been read by title only and further reading waived.

RECOMMENDED ACTION: Waive reading of ordinances and resolutions.

 

6.3   Treasurer’s Report

 

RECOMMENDED ACTION: Receive and File August 2005 monthly Treasurer’s Report.

 

6.4   Warrant Register

 

RECOMMENDED ACTION: Approve the September 14, 2005 Warrant Register in the amount of $3,185,382.11.

 

6.5 El Toro Road Landscaping and Irrigation Enhancement Project from Moulton Parkway to Paseo de Valencia

 

RECOMMENDED ACTION:  Award a contract to Mariposa Horticultural Enterprises, Inc., in the amount of $416,444.99, plus authorized change orders not to exceed 15% of the base amount; and authorize the City Manager to execute a contract and approve change orders, subject to approval of the contract as to form by the City Attorney.

 

6.6     Notice of Completion ? Belaire-West Landscape, Inc.

 

RECOMMENDED ACTION:

 

  1. Accept project completion of a contract with Belaire-West Landscape, Inc. for the El Toro Road Community Landscape Screening Project.

 

  1. Release contract retention in the amount of $6,794, withheld per government code, 35 days following recordation of Notice of Completion with the County of Orange.

 

  1. Exonerate project posted bonds 35 days following recordation of Notice of Completion with the County of Orange.

 

VII. PUBLIC HEARINGS

 

Public Hearings are scheduled for a time certain of 2:00 p.m. or as soon thereafter as possible. City Council, when considering the matter scheduled for hearing, will take the following actions: A. Receive staff report; B. Open the Public Hearing; C. Receive Public Comment; D. Close Public Hearing; E. Council comment and questions and take appropriate actions. Those wishing to address the City Council during the Public Hearing must complete a Request to Speak Form and provide it to the City Clerk prior to the Public Hearing.

 

7.1   Acquisition of Property for El Toro Road/Paseo de Valencia Intersection Improvements

 

RECOMMENDED ACTION:

 

  1. Receive Staff Report.

  1. Adopt a resolution authorizing the commencement of eminent domain proceedings to acquire interests in real property as described in the Resolution for street improvements on El Toro Road and Paseo de Valencia, entitled:

 

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAGUNA WOODS, CALIFORNIA, FINDING AND DETERMINING THAT THE PUBLIC INTEREST AND NECESSITY REQUIRE THE ACQUISITION OF A PORTION OF 24085 EL TORO ROAD FOR THE STREET WIDENING AND IMPROVEMENT OF EL TORO ROAD AND PASEO DE VALENCIA, A PUBLIC PURPOSE

 

7.2   Mayer Senior Condominium Project

 

RECOMMENDED ACTION:

 

  1. Receive staff report

 

  1. Open Public Hearing and continue to October 19, 2005.

8.1   Citizen Advisory Committee Appointments

 

RECOMMENDED ACTION: Approve proposed nomination(s) to City advisory committees.

 

8.2 Employee Compensation Ad Hoc Committee

 

RECOMMENDED ACTION:     Appoint Councilmembers Ring and Robbins to an ad hoc employee compensation committee.

 

8.3 Trauma Intervention Program (TIP) Heroes With Heart Dinner (agendized by Mayor Ross)

 

RECOMMENDED ACTION: Consider the allocation of $850 from the Council Contingency account for City participation in the October 28, 2005 TIP Heroes With Heart dinner.

 

  1. CITY MANAGER’S REPORT

 

9.1   Public Rights-of-Way Landscape Maintenance Services

 

RECOMMENDED ACTION: Authorize the City Manager to execute an agreement with TruGreen Landcare, Inc. for landscape maintenance services for one year with an option to extend for up to four additional single years, subject to approval of the agreement as to form by the City Attorney.

9.2   Laguna Woods Municipal Code

 

RECOMMENDED ACTION:     Introduce and approve first reading of an Ordinance adopting the Laguna Woods Municipal Code entitled:

 

AN ORDINANCE OF THE CITY OF LAGUNA WOODS, CALIFORNIA, ADOPTING AND ENACTING THE CITY OF LAGUNA WOODS, CALIFORNIA, MUNICIPAL CODE

 

9.3   Community Development Block Grant: Energy Efficiency Retrofit Program

 

RECOMMENDED ACTION: Award contracts to Dickson’s Heating and Air Conditioning and Shamrock Windows and Doors for the installation and replacement of heat pumps, windows and doors in qualified low income applicant residences, for an aggregate total cost not exceeding $150,000; and authorize the City Manager to execute the contracts, subject to approval of the contract as to form by the City Attorney.
