ADJOURNED REGULAR MEETING

June 1, 2005

  1. CALL TO ORDER

 

Mayor Ross called the Adjourned Regular Meeting of the City Council of the City of Laguna Woods to order at 2:00 p.m.

 

  1. FLAG SALUTE

 

Mayor Pro Tem Bouer led the flag salute.

STAFF PRESENT:    City Manager Keane; Assistant City Attorney McEwen; Assistant City Manager Reilly; Deputy City Clerk Fox

 

  1. CITY MANAGER’S REPORT

 

4.1 El Toro Road Golf Cart Path

 

Assistant Doug Reilly presented the staff report which presented the history of golf cart accessibility in the City. He discussed the actions taken by the City and the Golden Rain Foundation to fund the design and construction of a golf cart path on El Toro Road from the Leisure World golf course across the Lutheran Church property in front of the parking lot on the north side of El Toro Road. The Golden Rain Foundation provided the City with a resolution confirming their plan to proceed with the construction of its portion of the path and the Lutheran Church has provided documents stating their intent to provide a public right of way easement to the City and a separate easement to the Golden Rain Foundation.

 

Mayor Pro Tem Bouer stated this was a start to providing complete golf cart access within the City. However, there is still no access to the Methodist Church and Temple on Moulton Parkway and to the Mall and doctors at Saddleback in Laguna Hills.

 

Moved by Mayor Pro Tem Bouer, and seconded by Councilmember Robbins to adopt staff’s recommendation.

 

Councilmember Ring stated that even though Golden Rain Foundation adopted a resolution, the money will still need to be allocated. Therefore, he would like a bond or deposit account be provided by Golden Rain Foundation.

 

City Manager Keane reminded Council that if a golf cart path was built and Golden Rain Foundation did not complete their portion to access the City’s path, the City would be required to repay the money spent on the path.

 

Councilmember Hack expressed concerns over the proximity of golf carts and vehicles and advised he was not supportive of this plan.

 

Councilmember Robbins agreed that as a condition of the City going forward that Golden Rain Foundation be required to deposit money in an escrow account.

 

Cris Trapp, representing Golden Rain Foundation, advised Golden Rain Foundation has asked her to reiterate their commitment to build their portion of the path.

 

Harry Curtis, resident, briefly discussed licensed golf carts.

 

Discussion was held regarding use of the path by both licensed and unlicensed golf carts. Staff advised they will investigate and provide recommendations at a later meeting.

 

Ed Miller, resident, requested Council proceed with the plan.

 

Moved by Councilmember Robbins, seconded by Councilmember Ring and carried 4-1 to amend the motion to include that Golden Rain Foundation post acceptable securities.

The amended motion to appropriate $130,000 in existing AB 2766 Mobile Source Reduction funds for design and construction of the El Toro Road Electric Cart Path, add the capital project to the FY 04/05 budget, and require the Golden Rain Foundation to post acceptable securities carried 4-1.

4.2 Fiscal Year 2005-06 Budget – Grant Fund

 

City Manager Keane discussed the summary of the revenue sources and proposed expenditures associated with the Grant Fund and answered questions from Council She clarified that funds can only be used for purposes designated. Council consensus was to concur with the proposed expenditures.

  1. CITY ATTORNEY’S REPORT

 

Assistant City McEwen advised there was no report.

 

XII. PUBLIC COMMENTS

 

Harriet Arnest, resident, discussed the Gate 14/Home Depot slope and stated more needs to be done.

 

XIII. CITY COUNCIL COMMENTS AND ANNOUNCEMENTS

 

Councilmember Ring introduced Libby Marks who was honored this morning as Leisure Worlder of the Month. She requested an explanation of the traffic light sequence on El Toro Road. Assistant City Manager Reilly provided an explanation and advised they would be in working condition in four to six weeks.

 

Mayor Pro Tem Bouer briefly discussed the West Nile Virus and recommended people be careful when outside.

 

City Manager Keane advised the City would be fielding a team in the Aliso Niguel Woods American Cancer Relay for Life on June 11 and 12. She encouraged residents to call City Hall if they are interested in walking or donating money.

The meeting was adjourned at 2:50. p.m. to a regular meeting at 2:00 p.m. on June 15, 2005 at the Laguna Woods City Hall, 24264 El Toro Road, Laguna Woods, CA 92637.
