AGENDA DESCRIPTION: The Agenda descriptions are intended to give notice, to members of the public, of a general summary of items of business to be transacted or discussed. The listed Recommended Action represents staff or a particular Committee’s recommendation. The City Council may take any action which it deems to be appropriate on the agenda item and is not limited in any way by the recommended action. Any person wishing to address the City Council on any matter, whether or not it appears on this agenda, is requested to complete a “Request to Speak” form available at the door. The completed form is to be submitted to the City Clerk prior to an individual being heard by the City Council. Whenever possible, lengthy testimony should be presented to the City Council in writing (8 copies) and only pertinent points presented orally. Requests to speak to items on the agenda shall be heard at the appropriate point on the agenda; requests to speak about subjects not on the agenda will be heard during the Public Comment section of the meeting.

All proclamations listed under this section will be enacted by one vote, unless Members of the City Council request specific items be removed for separate action. Proclamations will then be read and presented.

 

5.1 Proclamation – Inner-Coastal Cleanup Day – September 16, 2006

 

5.2 Proclamation – National Alcohol and Drug Addiction Recovery Month – September 2006

 

  1. CONSENT CALENDAR

 

All matters listed under the Consent Calendar are considered routine and will be enacted by one vote. There will be no separate discussion of these items unless Members of the City Council, the public, or staff request specific items be removed from the Consent Calendar for separate action.

 

6.1 City Council minutes from the regular meeting of July 19, 2006.

 

RECOMMENDED ACTION: Approve minutes as submitted.

 

6.2   Approve the reading by title of all ordinances and resolutions. Said ordinances and resolutions that appear on the public agenda shall be determined to have been read by title only and further reading waived.

RECOMMENDED ACTION: Waive reading of ordinances and resolutions.

 

6.3   Treasurer’s Report

 

RECOMMENDED ACTION: Receive and File July 2006 monthly Treasurer’s Report and Fourth Quarter Fiscal Year 2005-06 Treasurer’s Report.

 

6.4   Warrant Register

 

RECOMMENDED ACTION: Approve the August 16, 2006 Warrant Register in the amount of $391,944.95.

 

6.5   Eminent Domain Proceedings

 

RECOMMENDED ACTION: Adopt an ordinance regulating the use of eminent domain entitled:

 

AN ORDINANCE OF THE CITY OF LAGUNA WOODS, CALIFORNIA, REGULATING THE USE OF EMINENT DOMAIN FOR ECONOMIC DEVELOPMENT

 

6.6   Notice of Completion – El Toro Road Golf Cart Path Project

 

RECOMMENDED ACTION:

 

  1. Accept project completion of a contract with Belaire-West Landscape, Inc. for the El Toro Road Golf Cart Path Project.

 

  1. Release contract retention in the amount of $7,164.74 withheld per government code 35 days following recordation of Notice of Completion with the County of Orange.

 

  1. Exonerate project posted bonds 35 days following recordation of Notice of Completion with the County of Orange.

 

6.7   Community Development Block Grant: Energy Efficiency Retrofit       Program

 

RECOMMENDED ACTION:    Approve three year agreements and associated equipment unit prices with Dickson’s Heating and Air Conditioning and Saddleback Windows for the installation of energy efficiency equipment for low income residents; and authorize the City Manager to execute the agreements subject to approval as to form by the City Attorney.

 

VII. PUBLIC HEARINGS

 

Public Hearings are scheduled for a time certain of 2:00 p.m. or as soon thereafter as possible. City Council, when considering the matter scheduled for hearing, will take the following actions: A. Receive staff report; B. Open the Public Hearing; C. Receive Public Comment; D. Close Public Hearing; E. Council comment and questions and take appropriate actions. Those wishing to address the City Council during the Public Hearing must complete a Request to Speak Form and provide it to the City Clerk prior to the Public Hearing.

VIII. CITY COUNCIL

 

8.1 Citizen Advisory Committee Appointments

 

RECOMMENDED ACTION: Approve nominations to committees to fill unexpired terms.

 

8.2 City Council Meeting Schedule

 

RECOMMENDED ACTION:

 

  1. Schedule an adjourned regular meeting for 2:00 p.m. on Tuesday, August 22, 2006.

 

  1. Reschedule Council’s regular November 15, 2006 meeting to 2:00 p.m. on Wednesday, November 8, 2006.

 

8.3 City Council Appointments to Regional Boards and Committees

 

RECOMMENDED ACTION:

 

  1. Appoint Councilmember Bert Hack as the City’s representative to the Southern California Water Committee.

 

  1. Appoint Mayor Pro Tem Milt Robbins as the City’s representative to the Orange County Transportation Authority’s South County Major Investments Study Policy Committee.

 

  1. CITY MANAGER’S REPORT

 

9.1   Barbed Wire Intrusions into Public Rights of Way

 

RECOMMENDED ACTION: Discuss and consider the following options:

 

  1. Require property owners (Laguna Woods Village homeowners associations) to indemnify the City for any injuries associated with barbed wire located along or adjacent to community perimeter walls. (interim measure)

 

  1. Require property owners to remove and relocate barbed wire so that it does not intrude into the public rights of way. (establish time frame for removal)

 

C     Agree to fund the removal of barbed wire that intrudes into City rights-of-way; and grant an exception to the Municipal Code and allow the property owners to relocate the barbed wire that is removed to their property.

 

9.2   Non-Emergency Medical Transportation

 

RECOMMENDED ACTION: Discuss and consider action to modify the     City’s non-emergency medical transportation “gap” program.
